Effective from 5 April 2025, the Civil Aviation Act 2023 allows participants to seek an Independent Review of some decisions of the Director of Civil Aviation, or delegate.
The Minister of Transport has appointed a panel of independent reviewers for this function, which is supported by the Ministry of Transport.
Decisions which can be independently reviewed are set out in the Civil Aviation (Independent Review Function) Regulations 2025. They include those taken that are appealable to the District Court (under section 453(3) of the Civil Aviation Act 2023); and those on whether to grant individual exemptions from regulations or the Civil Aviation Rules.
More information about seeking an independent review, including how to apply, is available on the Ministry of Transport website(external link)
